Embr Labs Rewards Program is a free rewards program offered by Embr Labs (the “Company") to its customers in the Rewards Program (the “Program").
Membership & Eligibility
The Program is limited to individuals only and is limited to one account per individual. Program members must be 16 years or older to be eligible for Membership. Eligible minors must obtain their parent's or legal guardian's consent prior to participation.
BY APPLYING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). NO PURCHASE IS NECESSARY TO BECOME A PROGRAM MEMBER.
Earning and Redeeming Rewards Points
Earning Points
Under the Program, each member will have reward points credited to their account for every reward action completed (a “Reward Point”).
Any reference to "merchandise" or the value of merchandise in these Terms for purposes of collecting Reward Points includes all Company products* sold online at embrlabs.com (*Exclusions may apply). It does not include payment for taxes and shipping fees as payment for taxes and shipping are ineligible for Reward Point collection.
Redeeming Points
As part of the Benefits of being a member, your Reward Points may be redeemed for rewards made available by the Company from time to time at its sole discretion (“Rewards”). You are eligible to redeem Reward Points for a Reward if you have enough Reward Points in your account. Rewards can only be redeemed online.
The Reward redemption cannot be combined with any coupons or promotions. Reward Points will not be earned on any orders paid with Reward Points.
The Company may, at its sole discretion, allow Reward Points to be redeemed for other benefits or items of merchandise from time to time.
Point Expiration
It's our hope that you redeem your Program Reward Points on a regular basis. All unredeemed Program Reward Points will expire when a program member has not engaged in Reward Point activity associated with that membership account (through purchase or redemption) for 12 months. If you have questions regarding the date of your last Reward Point activity or your last purchase, please consult your account page at embrlabs.com/account. Additionally, Program Points will automatically expire if your Membership is revoked or otherwise canceled for the reasons further set forth in Section named “Changes, Termination and/or Removal from Program.”
Referral Program
Qualified Referral. A Qualified Referral is defined as 1) a purchase of an Embr Wave 2 device or 2) a verified subscription to the Embrship, made on the Company Site by a person (a “Referred Customer”) who arrives to the Company’s website by clicking the Referring Program Member’s (the “Referrer”) Referral Program link. Referrers are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
Referred Customer. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address). The Referred Customer must be a new customer to the Site. The Referred Customer purchase must be greater than or equal to $20 to use the $20 referral coupon code. Only one code per order.
Referral Rewards. To earn referral rewards as a Referrer, the Referred Customer must successfully complete a one-time purchase for an Embr Wave 2 device, or 2) successfully complete and be approved for the first month of an Embrship Subscription. The Referrer may only use one $20 referral coupon code per order. Referral rewards may not be combined with other promotional codes, loyalty points, or special sales.
Eligibility. Eligibility is limited to individuals only. Company’s Referral Program cannot be used by businesses for affiliate lead generation.
No Spam. Referrers must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of Program referral links that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Company’s Referral Program.
Right to Close Accounts. The Company reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Company Referral Program in a questionable manner, breaches any of these terms and conditions, or is in violation of any law, statute or governmental regulation.
Right to Cancel Program or Change Terms. The Company reserves the right to cancel the Referral Program or to change these terms and conditions at any time in its sole discretion. Any unclaimed referral rewards will be forfeited at that time.
Subscription Milestones
Program Structure
The Program rewards subscribing participants based on milestones achieved, each associated with specific rewards. The Company reserves the right to modify the Program structure, milestones, and rewards at any time, without prior notice.
Earning Rewards
Participants are eligible to earn rewards upon reaching specific subscription milestones as determined by the Company. Rewards may include but are not limited to discounts, free products, exclusive offers, and other benefits as determined by the Company. The Company will communicate the details of each milestone and associated rewards to Participants via email or other communication channels the Company may use.
Redemption of Rewards
Participants can redeem earned rewards within the designated redemption period specified by the Company. Redemption instructions and restrictions will be provided by the Company. Rewards are non-transferable, non-exchangeable, and have no cash value.
Changes, Termination and/or Removal from Program
The Company may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, Rewards, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) or may terminate the Program at any time at its sole discretion, by posting any such changes on the Company’s website.
YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES AND ANY NEW TERMS.
The Company reserves the right to exclude individuals from the Program or remove Rewards Points from a member's account in its sole but reasonable discretion. In particular, any abuse, manipulation or "gaming" of the Program or its rules (as determined by the Company), failure to follow any terms of the Program, Membership inactivity for more than 12 months, any misrepresentation or conduct detrimental to the interests of the Company not otherwise protected by law may subject members to Membership revocation or deduction of Reward Points obtained through these abusive or manipulative activities and will affect eligibility for further participation in the Program. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any Reward Points in your account will automatically expire.
The Company reserves the right to make changes to its Website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms.
